Acceptance of Terms

By accessing and using the Nitya Tours & Travels website and booking our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our services.

Throughout these Terms & Conditions, the following definitions apply:

  • "Company," "We," "Us," "Our" refers to Nitya Tours & Travels
  • "Client," "You," "Your" refers to the person booking or using our services
  • "Package," "Tour," "Service" refers to travel products and services offered by us
  • "Website" refers to Nitya Tours & Travels and its subdomains

Booking and Payment

Booking Confirmation

A booking is considered confirmed only after we receive the required deposit or full payment and issue a booking confirmation voucher. All bookings are subject to availability at the time of reservation.

Payment Terms

  • A non-refundable deposit of 25% to 50% of the total tour cost is required at the time of booking
  • The remaining balance must be paid at least 30 days prior to the departure date
  • For bookings made within 30 days of departure, full payment is required at the time of booking
  • Payments can be made via bank transfer, credit/debit card, UPI, or other methods as specified
  • All applicable taxes and service charges are included in the quoted price unless stated otherwise

Price Guarantee

We strive to provide accurate pricing. However, prices are subject to change due to fluctuations in currency exchange rates, fuel costs, government taxes, or other unforeseen factors. Once a booking is confirmed and paid, the price is locked in.

Cancellation and Refunds

Cancellation and refund policies vary depending on the tour package and service provider. Please refer to our Cancellation & Refund Policy for detailed information on cancellation charges, timelines, and refund processes.

Travel Documentation

The client is solely responsible for obtaining and carrying all required travel documents, including:

  • Valid passport (with minimum 6 months validity from the travel date)
  • Visas for the countries being visited
  • Travel insurance (highly recommended)
  • International driving permits (if applicable)
  • Vaccination certificates (if required)

We are not liable for any visa denials, passport issues, or documentation problems that may affect your travel.

Health and Medical

Clients must inform us of any pre-existing medical conditions, allergies, or special requirements at the time of booking. We reserve the right to refuse service or require a medical certificate if we believe a tour may be unsuitable for a client's health condition. Clients travel at their own risk regarding health matters.

Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, flight delays, and personal liability. We are not responsible for any losses arising from lack of adequate insurance coverage.

Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information during booking
  • Comply with all laws, regulations, and customs of the destinations visited
  • Respect local cultures, traditions, and environments
  • Follow the instructions of tour guides and representatives
  • Not engage in any illegal or disruptive activities during the tour
  • Take responsibility for your personal belongings and safety

Changes and Modifications

Changes by the Client

Any requested changes to a confirmed booking (dates, destinations, accommodations) are subject to availability and may incur additional charges. We will make reasonable efforts to accommodate changes but cannot guarantee them.

Changes by the Company

We reserve the right to modify itineraries, substitute accommodations, or alter travel arrangements due to unforeseen circumstances such as weather conditions, political unrest, natural disasters, or operational requirements. In such cases, we will provide equivalent or better alternatives where possible.

Limitation of Liability

Nitya Tours & Travels acts as an intermediary between clients and service providers (hotels, airlines, transport operators, etc.). We are not liable for:

  • Any loss, injury, damage, or delay caused by acts of God, natural disasters, or force majeure events
  • Acts or omissions of third-party service providers
  • Personal injury, illness, or death during the tour
  • Loss or damage to personal belongings
  • Flight cancellations, delays, or schedule changes by airlines

Our total liability shall not exceed the total amount paid by the client for the specific tour package in question.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, government restrictions, or adverse weather conditions.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to mediation or arbitration as per the Arbitration and Conciliation Act, 1996.

Intellectual Property

All content on our website, including text, images, logos, and software, is the property of Nitya Tours & Travels or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or modify any content without our written permission.
